Welcome to 2AM PROJECT (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your use of our website, online ordering pages, reservation tools, mobile experience, and any other digital services we provide (collectively, the “Site”).

By accessing or using the Site, placing an order, making a reservation, signing up for updates, or otherwise interacting with us online, you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

You may use this Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable law or regulation

  • Attempt to gain unauthorized access to the Site, servers, or systems

  • Interfere with the operation or security of the Site

  • Use automated tools, bots, scraping tools, or similar methods without permission

  • Submit false, misleading, or fraudulent information

  • Impersonate another person or business

  • Use the Site in a way that could damage our brand, operations, or other users

2. Online Ordering

If our Site allows online ordering, you agree that:

  • All orders are subject to availability and acceptance

  • We may refuse, cancel, or limit any order at our discretion

  • Menu items, prices, availability, portion sizes, and preparation times may change without notice

  • Estimated pickup or delivery times are estimates only and are not guaranteed

  • You are responsible for reviewing your order before submitting it

  • Once an order is submitted, changes or cancellations may not be possible

We may contact you if an item is unavailable, if we need to substitute an item, or if there is an issue with your order.
 

3. Pricing and Payment

Prices shown on the Site are listed in [U.S. Dollars] unless otherwise stated. Prices may differ from in-store pricing and may vary across delivery platforms, third-party marketplaces, promotions, or locations.

You agree that:

  • Applicable taxes, service charges, delivery charges, platform fees, or other disclosed charges may be added at checkout

  • You are responsible for paying all charges associated with your order

  • We may correct pricing errors, typographical mistakes, or inaccurate descriptions at any time

  • We may cancel orders affected by obvious pricing or technical errors

Payment processing may be handled by third-party providers. We do not store full payment card information unless specifically stated.
 

4. Pickup and Delivery

For pickup orders, you are responsible for arriving during the stated pickup window and verifying that you received the correct order.

For delivery orders:

  • Delivery availability depends on location, hours, staffing, weather, and third-party partner availability

  • Delivery times are estimates only

  • We are not responsible for delays caused by traffic, weather, third-party delivery services, or events outside our control

  • Risk of loss or quality issues may pass to you once the order is handed off for delivery, where permitted by applicable law
     

5. Refunds, Credits, and Order Issues

Because food is perishable, all sales are generally final unless we determine otherwise. Depending on the situation, we may offer a replacement, store credit, partial refund, or other resolution in our discretion.

We reserve the right to request information about the issue, including your order number, photos, or a description of the problem.
 

6. Reservations and Waitlists

If our Site offers reservations or waitlist features:

  • Reservations are subject to availability

  • We may impose time limits, party size limits, deposits, or cancellation rules

  • We may cancel or modify reservations due to operational needs, emergencies, private events, weather, or other circumstances

  • You are responsible for arriving on time

  • Late arrivals may result in reduced seating time, waitlist placement, or cancellation

Any specific reservation policies posted on the reservation page are incorporated into these Terms.
 

7. Promotions, Discounts, and Gift Cards

From time to time, we may offer promotions, coupon codes, discounts, rewards, loyalty benefits, or gift cards. Unless otherwise stated:

  • Promotions cannot be combined with other offers

  • Promotions have no cash value

  • Promotions may expire without notice

  • Promotions may be limited by location, date, time, menu item, or order channel

  • We may modify or cancel promotions at any time

  • Lost or stolen gift cards may not be replaceable unless required by law

Additional terms may apply to any promotion, loyalty program, or gift card.
 

8. Allergies and Food Safety

We prepare food in kitchens that may handle common allergens, including but not limited to milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soy, and sesame.

We do not guarantee that any menu item is completely free of allergens or cross-contact. If you have a food allergy, sensitivity, or dietary restriction, please contact us directly before ordering.

By placing an order, you acknowledge that:

  • Ingredient and preparation information may change

  • Cross-contact may occur

  • You are responsible for informing us of any allergies or restrictions before ordering
     

9. Nutritional and Menu Information

Any nutritional, ingredient, spice-level, or menu descriptions on the Site are provided for general informational purposes only. Actual preparation, ingredients, portion sizes, and availability may vary by location, supplier, and time.

We do not guarantee that menu descriptions are complete, current, or error-free.
 

10. Accounts and Communications

If you create an account, sign up for updates, join a loyalty program, or provide contact information, you agree to provide accurate and current information.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

By providing your email address or phone number, you agree that we may send you service-related communications about your orders, reservations, account activity, or other transactional matters. If you separately opt in to marketing communications, you may also receive promotional messages, subject to your unsubscribe or opt-out rights.
 

11. SMS and Email Terms

If you opt in to receive marketing emails or text messages from us:

  • Message frequency may vary

  • Message and data rates may apply for text messages

  • Consent is not a condition of purchase

  • You can unsubscribe from marketing emails using the unsubscribe link

  • You can opt out of marketing texts by replying STOP, where applicable

We may still send non-marketing service or transaction messages when necessary.
 

12. Intellectual Property

All content on the Site, including text, graphics, logos, icons, menus, photos, videos, designs, trademarks, service marks, and other materials, is owned by or licensed to 2AM PROJECT and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, republish, display, or exploit any Site content without our prior written permission, except for personal, non-commercial use related to placing orders or learning about our restaurant.
 

13. User Content and Feedback

If you submit reviews, comments, photos, suggestions, testimonials, messages, or other content to us, you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, display, publish, adapt, and share that content in connection with our business, marketing, and operations.

You represent that:

  • You own or control the content you submit

  • Your content does not violate any law or third-party rights

  • Your content is not false, defamatory, threatening, obscene, or infringing

We reserve the right to remove or refuse any user-submitted content.
 

14. Third-Party Services and Links

The Site may contain links to or integrations with third-party services, including ordering platforms, delivery providers, reservation systems, payment processors, social media platforms, analytics tools, or advertising providers.

We are not responsible for the content, availability, policies, or practices of third-party services. Your use of those services may be governed by their own terms and privacy policies.
 

15. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT:

  • THE SITE WILL ALWAYS BE AVAILABLE, SECURE, OR ERROR-FREE

  • THE SITE WILL BE FREE OF VIRUSES OR HARMFUL CODE

  • ANY DEFECTS WILL BE CORRECTED

  • ANY INFORMATION ON THE SITE WILL ALWAYS BE COMPLETE, ACCURATE, OR CURRENT
     

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, [RESTAURANT NAME], ITS OWNERS, AFFILIATES, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY ORDER, RESERVATION, COMMUNICATION, OR SERVICE PROVIDED THROUGH THE SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR YOUR USE OF IT WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN CONNECTION WITH THE APPLICABLE TRANSACTION GIVING RISE TO THE CLAIM, OR $100 IF NO PURCHASE WAS MADE, TO THE EXTENT PERMITTED BY LAW.
 

17. Indemnification

You agree to defend, indemnify, and hold harmless 2AM PROJECT, its affiliates, owners, officers, employees, agents, and service providers from and against any claims, damages, losses, liabilities, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your use of the Site

  • Your violation of these Terms

  • Your violation of applicable law

  • Your infringement of any third-party rights

  • Any content or information you submit
     

18. Governing Law

These Terms are governed by the law, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts, and you consent to the jurisdiction of those courts.
 

19. Dispute Resolution

Before filing a legal claim, you agree to first contact us and attempt to resolve the issue informally.

If you want to include arbitration, class action waiver language, or venue-specific dispute procedures, that should be added carefully and reviewed by a lawyer before posting.
 

20. Termination

We may terminate or suspend your access to the Site at any time, with or without notice, for any reason, including suspected fraud, misuse, security concerns, or violation of these Terms.

We may update these Terms from time to time. When we do, we will post the revised version on this page and update the “Last Updated” date above.

Your continued use of the Site after updated Terms are posted constitutes your acceptance of the revised Terms, to the extent permitted by law.
